The FTC is releasing an update to its Green Guides, which provide marketers with guidance on environmental marketing claims, this year. In advance of updating the Green Guides, the FTC received nearly 60,000 responses to questions it posed about common environmental claims, ranging from “low carbon” to “net zero” to claims concerning the recyclability, sustainability and compostability of products. As consumers have focused their purchasing on environmentally friendly products, brands have expanded their marketing and advertising to include a variety of claims touting their products as safe for the environment. The FTC and courts have also become more focused on ensuring that marketers’ “green” claims are truthful and accurate.

Fenwick's trademark litigation partner Eric Ball will attend the 2024 IPO Annual Meeting to participate in a panel titled, "Greenwashing and Navigating the FTC’s Green Guides," on Monday, September 23 from 11:00am-12:00pm PT. This session will discuss the FTC’s Green Guides, recent FTC actions to enforce those guides, and trends in consumer class actions and other litigation around green claims.
