With artificial intelligence poised to generate a vastly more complex patent process, Managing IP turned to Fenwick intellectual property partner Bob Hulse for clarity on a nascent but significant issue.
In an article about the U.S. Patent and Trademark Office’s growing interest in the effects of AI on prior art, obviousness, and demonstrations of patentability, Bob explained the potential future influx of AI-generated prior art and contextualized the issue for today.
“We’re really at the very beginning,” Bob told Managing IP. “A lot of issues they’ve raised are interesting and aren’t yet being felt by patent applicants. I have never received a piece of prior art cited against my patent applications that was written by AI.”
