Stuart works with technology companies at all stages on a range of IP-related matters, including securing IP rights for patents, copyrights, and beyond; developing trade secrets policies; managing patent reexaminations and other post-grant matters; representing companies in technology-focused litigation; performing strategic IP planning and audits; and managing risk for clients who use or provide AI systems. Stuart has been on the cutting-edge of technology and the law throughout his career. In the 1980s, he represented MIT in litigation involving the RSA encryption patent, which is fundamental to data privacy. Throughout the early 2000s, he advised Compuware in a landmark dispute with IBM that resulted in a $400 million settlement, patent cross-licensing agreements, and a variety of sub-contracting deals between the two companies. In recent years, Stuart has become a leading voice in AI, writing and speaking on the topic often and bringing together technology law professionals, researchers and industry representatives from around the world through ITechLaw. He is a chapter author in the second edition of “Overlapping Intellectual Property Rights” (Oxford University Press, 2023) and a co-author of “Responsible AI: A Global Policy Framework,” (ITechLaw, 2019).

Stuart co-chairs Fenwick’s post-grant proceedings practice and also maintains an active pro bono practice focused on increasing diversity in the IP arena. He represented Fenwick as a founding member of the group that created the California Inventors Assistance Program, a pro bono program in cooperation with the U.S. Patent and Trademark Office and California Lawyers for the Arts. He currently serves on the organization’s advisory board.
